𝐓𝐡𝐞 𝐇𝐢𝐠𝐡 𝐂𝐨𝐮𝐫𝐭 𝐨𝐧 𝐂𝐨𝐧𝐜𝐮𝐫𝐫𝐞𝐧𝐭 𝐀𝐫𝐛𝐢𝐭𝐫𝐚𝐭𝐢𝐨𝐧𝐬 𝐚𝐧𝐝 𝐈𝐧𝐝𝐞𝐩𝐞𝐧𝐝𝐞𝐧𝐭 𝐉𝐮𝐝𝐠𝐦𝐞𝐧𝐭 Congratulations to my colleagues Siraj Omar, S.C., Larisa Cheng and Fitzgerald Hendroff on successfully defending the challenge in 𝘋𝘚𝘚 𝘷 𝘋𝘚𝘛 [2026] SGHC 145. It was also a privilege for our team to work alongside Ryan Tan and Sidley Austin LLP on this matter. The case raised an interesting question. The claimant sought to set aside an arbitral award on the basis that substantial portions of the award had been copied from a related award issued in a concurrent arbitration. Relying on 𝘋𝘑𝘗 𝘷 𝘋𝘑𝘖, it argued that the similarities were so extensive that they demonstrated apparent bias and a failure by the Tribunal to exercise independent judgment. The High Court rejected the challenge. What I found particularly interesting is the Court's nuanced treatment of the "copying" issue. The Court recognised that not all similarity is objectionable. Where arbitrations are heard concurrently, involve the same factual matrix, share common evidence and overlapping issues, it is hardly surprising that tribunals may reach similar conclusions and sometimes express those conclusions in similar terms. The critical question was not whether the awards looked alike. The critical question was whether the Tribunal had independently engaged with the issues before it. Unlike 𝘋𝘑𝘗 , the Court found that the Tribunal had demonstrated that it was alive to the differences between the proceedings, addressed arguments specific to the arbitration before it, and exercised its own judgment even where it ultimately reached the same conclusions as the tribunal in the related arbitration. The practical takeaway is a useful one: 👉 Similar awards do not necessarily mean biased tribunals. 👉 Similar reasoning does not necessarily mean copied reasoning. 👉 The focus remains on whether the tribunal independently considered and determined the issues before it. A significant result for the client and a fascinating judgment on the line between legitimate overlap and apparent bias in concurrent arbitrations.   • 𝐘𝐨𝐮 𝐂𝐚𝐧’𝐭 𝐇𝐚𝐯𝐞 𝐈𝐭 𝐁𝐨𝐭𝐡 𝐖𝐚𝐲𝐬: 𝐓𝐡𝐞 𝐂𝐨𝐮𝐫𝐭 𝐨𝐟 𝐀𝐩𝐩𝐞𝐚𝐥 𝐨𝐧 𝐈𝐦𝐩𝐞𝐫𝐦𝐢𝐬𝐬𝐢𝐛𝐥𝐞 𝐇𝐞𝐝𝐠𝐢𝐧𝐠 The team from Siraj Omar LLC, comprising Siraj Omar, S.C., Larisa Cheng and Bumsoo Kim had the privilege of acting as instructed counsel for 𝘎𝘕𝘊 in this Appeal before the Court of Appeal. The successful outcome was a highly collaborative effort with the outstanding team Reed Smith LLP / Resource Law LLC, comprising Adrian Aw and Ian Choi, and it was a real pleasure working together on this matter. The decision is a timely reminder of a hard truth in arbitration strategy: 👉 𝐲𝐨𝐮 𝐜𝐚𝐧𝐧𝐨𝐭 𝐤𝐞𝐞𝐩 𝐚 𝐝𝐮𝐞 𝐩𝐫𝐨𝐜𝐞𝐬𝐬 𝐨𝐛𝐣𝐞𝐜𝐭𝐢𝐨𝐧 𝐢𝐧 𝐲𝐨𝐮𝐫 𝐛𝐚𝐜𝐤 𝐩𝐨𝐜𝐤𝐞𝐭 𝐰𝐡𝐢𝐥𝐞 𝐟𝐢𝐠𝐡𝐭𝐢𝐧𝐠 𝐭𝐡𝐞 𝐜𝐚𝐬𝐞 𝐨𝐧 𝐭𝐡𝐞 𝐦𝐞𝐫𝐢𝐭𝐬. Building on 𝘊𝘩𝘪𝘯𝘢 𝘔𝘢𝘤𝘩𝘪𝘯𝘦, the Court made clear that if a party says the process is fundamentally unfair, it must say so clearly and act on it - there and then. What makes this decision particularly significant is how it sharpens the line drawn in 𝘊𝘈𝘑 𝘷 𝘊𝘈𝘐: 👉𝘊𝘈𝘑 allows a party to object and make limited, protective responses; 👉but this case confirms that once a party 𝐟𝐮𝐥𝐥𝐲 𝐞𝐧𝐠𝐚𝐠𝐞𝐬 𝐭𝐡𝐞 𝐦𝐞𝐫𝐢𝐭𝐬 𝐰𝐢𝐭𝐡𝐨𝐮𝐭 𝐩𝐮𝐫𝐬𝐮𝐢𝐧𝐠 𝐩𝐫𝐨𝐜𝐞𝐝𝐮𝐫𝐚𝐥 𝐫𝐞𝐦𝐞𝐝𝐢𝐞𝐬, it risks losing that objection altogether. In the Court’s analysis, trying to do both - object and litigate the merits - is impermissible hedging. 𝐏𝐫𝐚𝐜𝐭𝐢𝐜𝐚𝐥 𝐭𝐚𝐤𝐞𝐚𝐰𝐚𝐲: If you think the arbitration has gone off the rails, you have to 𝐜𝐚𝐥𝐥 𝐢𝐭 𝐨𝐮𝐭, 𝐬𝐩𝐞𝐜𝐢𝐟𝐲 𝐭𝐡𝐞 𝐫𝐞𝐦𝐞𝐝𝐲, 𝐚𝐧𝐝 𝐟𝐨𝐥𝐥𝐨𝐰 𝐭𝐡𝐫𝐨𝐮𝐠𝐡. Proceeding “just in case” will likely shut the door on any later challenge. They demand coordinated strategy, deep subject‑matter knowledge, and close collaboration across legal systems and time zones. Against that backdrop, Siraj Omar LLC recently acted for the Kingdom of Spain in Singapore High Court proceedings concerning the registration and enforcement of an ICSID arbitral award arising out of Energy Charter Treaty disputes. The matter raised complex issues at the intersection of public international law, investor‑State arbitration, and domestic statutory frameworks governing recognition and enforcement. Beyond the immediate outcome, the proceedings illustrate how Singapore continues to function as a key forum for sophisticated international disputes, and how enforcement proceedings can themselves involve significant legal and strategic questions extending well beyond the arbitral phase. The work was undertaken as part of a genuinely collaborative cross‑border effort, drawing on the combined experience of our disputes team — Siraj Omar, S.C., Allister Tan, Larisa Cheng, Fitzgerald Hendroff and Darryl Hor — working closely with colleagues at Sidley Austin LLP, including Simón Navarro González, Desmond Ang and Ryan Tan. This collaboration was central to navigating the multi‑layered legal issues the case presented.
